Terms and conditions of service

 

These terms and conditions create a contract between you and STOPGIVER (the “Agreement”). Please read the Agreement carefully. To confirm your understanding and acceptance of the Agreement, click “Agree in the applications”. To create an account you need to have agreed these. 

INTRODUCTION TO OUR SERVICES 

This Agreement governs your use of the STOPGIVER application made available by STOPGIVER Ltd. Through the STOPGIVER application you can access content and other in-app services from STOPGIVER. To use our Services, you need to sign into our software.

USING OUR SERVICES

STOPGIVER is a free to use application that allows you to access the STOPGIVER Platform content.

PRIVACY

Your use of our Services is subject to STOPGIVER Privacy Policy. This Privacy Policy applies to the STOPGIVER app available on iOS, Android, web and any other platforms.

INFORMATION WE COLLECT

1. Non-personal Information

We may collect anonymised non-personal information for troubleshooting and analytics.

2. Information you provide

We may collect your information when you communicate with us or you give us by email, contact forms etc. 

HOW WE USE INFORMATION

1. Personal Information

We do not store Personal Information other than that required to identify you as a user of the platform. 

2. Non-Personal Information

We do not sell, trade, or otherwise transfer your information to outside parties. 

SERVICES AND CONTENT USAGE RULES

Your use of the Services and Content must follow the rules set forth in this section (“Usage Rules”). Any other use of the Services and Content is a material breach of this Agreement. STOPGIVER may monitor your use of the Services and Content to ensure that you are following these Usage Rules.

All Services:

You may use the Services and Content only for personal, non-commercial purposes (except as set forth in the Content Store section below).

STOPGIVER delivery of Content does not transfer any commercial or promotional use rights to you and does not constitute a grant or waiver of any rights of the copyright owners.

You may not tamper with or circumvent any security technology included with the Services.

You may access our Services only using STOPGIVER software and may not modify or use modified versions of such software.

The term “Content” includes contents for the STOPGIVER application, STOPGIVER websites or any third party products used within the STOPGIVER platform or applications.

CHANGES 

Our Privacy Policy may change which will not reduce your rights under this Privacy Policy from time to time, we will post any privacy policy changes on this page. If you do not agree to any modifications to this Policy, you could immediately stop all use of all the Services. Your continued use of the app following the posting of any modifications to this Policy will constitute your acceptance of the revised Policy.

IN-APP WALLET 

The STOPGIVER mobile application offers an “in-app” wallet which can be loaded for the sole use of donations to causes. Once loaded the money can only be used for donation to a cause. No repayment of funds will be allowed

PUSH NOTIFICATIONS 

STOPGIVER may send push notifications to app users. In most cases users have control over whether or not they receive notification from the STOPGIVER application.

You may in most cases opt out of receiving push notifications by going to your device “Settings” and clicking on “Notifications” and then changing those settings for some or all of the apps on your device. Different device configurations, or updates to devices may affect or change how these settings work.

USAGE RULES

STOPGIVER will regularly update and amend these rules on a regular basis so please check them often. We will update any changes on the STOPGIVER.com website. The current version is 13th August 2020.

The user agreement is between you and STOPGIVER Ltd. To use the application you must accept these user rules and terms. If you do not, you must not use our website or application.

We are registered for VAT in the United Kingdom and our registered number at Companies House is 12117474.

STOPGIVER ACCOUNT

You don't have to create an account to view the website but if you do decide to create one you need to be aged 13 years or over and if under 18 must have obtained your guardians permission to use the site.

You must not share your password or login details with anyone else. If your password is compromised or used without your permission, you must change your password and/or login details as soon as possible.

We'll use the details on your account if we need to contact you.

If you want to close your account, please contact us.

We'll close your account if you've not used it for seven years.

YOUR CAUSES

In order to set up or support a cause you'll need to create an account. The creation of a cause doesn't mean that we or the Charity concerned support or endorse your fundraising activity. StopGiver is not endorsed or aligned to any Charities. They may wish to come on to the platform and this will be indicated by the transparency level. The current list of Charities on the website are those that StopGiver wishes to support from your donations and will be passed on after deduction of the platform fee and external transaction charges.

If a charity is not on the website it can be requested from us by writing to laurence@STOPGIVER.co.uk.

It must have a registered number and be on the charities commission website for England and Wales or on the Scottish Charity Register.

We can close your cause at the request of the Charity or at our own discretion. 

While we try to ensure that the STOPGIVER and the app are always available, we can't guarantee that the website or any content on it will always be available. For example, there may be times when our website, or parts of the website, are temporarily unavailable due to planned maintenance.

We can suspend your access to the STOPGIVER website, the app and/or your account at our discretion. In particular, we can do this if we suspect that your security or login details are being misused. 

USING THE STOPGIVER WEBSITE AND APP 

You agree that you will not post content or information on the website or the app that:

  • is defamatory, abusive or offensive;

  • breaks any law or encourages an illegal act;

  • infringes the copyright, privacy, confidentiality or other right of any third party.

  • contains surveys, raffles, lotteries, contests, pyramid schemes, advertisements or chain letters; or

  • contains software viruses or any other computer code, files or programs designed to affect the use of any computer software or hardware or telecommunications equipment.

If you use someone else’s personal information, material or image, you must make sure you have their permission.

You're not allowed to remove or change anything on the STOPGIVER website and the app other than the content on your causes. In addition, you can't:

  • pretend to be someone else, or that you are associated with someone or something when you are not; or

  • use the STOPGIVER website to send junk email or 'spam'.

The content on the STOPGIVER website and the app is for general information only. It's not intended to be advice for you to rely on so you should consider getting professional or specialist advice before acting on it.

We don't verify or approve any content or information on the STOPGIVER website or the STOPGIVER app that is created by other users and/or Charities so we don't take responsibility for it (although we'll remove or disable unlawful or offensive content if we become aware of it). The views expressed by other users and Charities are their own views so they won't always reflect our views and values.

The STOPGIVER website and the STOPGIVER app will sometimes link to other websites. We don't have control over those websites and we're not responsible for them (including their data policies, content, and security).

Who owns the information on the STOPGIVER website and the STOPGIVER app?

You own all of the content and information you post on the STOPGIVER website and the STOPGIVER app. You agree to the following:

For content that is covered by intellectual property rights, like photos and videos that you post on or in connection with STOPGIVER ("IP content"), you give STOPGIVER permission to use the IP content anywhere in the world, forever and without charge and you give us permission to edit the IP content. You also agree that we can transfer or give permission to use and/or edit the IP content to another party; and

You can ask us to stop using the IP content by contacting us when you delete it on your account (except to the extent your content has been shared with others, and they have not deleted it). When you delete (or you ask us to delete) the IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. You understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).

Otherwise, we own or have permission to use all of the intellectual property rights on the STOPGIVER website and the STOPGIVER app and in the material published on them ("STOPGIVER content"). STOPGIVER content includes (but isn't limited to) information, designs, graphics and their layout.

You need written permission from us before you:

  • use any part of the STOPGIVER content for commercial purposes;

  • copy, reproduce or download all or any part of the STOPGIVER content.

If you don't get written permission first, you must return or destroy any copies of the STOPGIVER content you have made if we ask you to.

CAN THESE USER TERMS BE CHANGED?

We may change these User Terms because of changes:

  • in technology or the systems we use or in the content that we supply;

  • to meet our legal or regulatory obligations;

  • to make them clearer or more favourable to you or to correct errors; and

  • to introduce or remove services or to reflect changes to the way in which the STOPGIVER website is managed.

We won't give you notice but you'll always be able to find the most up-to-date version on the STOPGIVER website.
